it was just as bad when his attorney general and secretary of homeland security said they hadn't read the bill before condemning it. i would like to remind you, this has now become a national security issue. last week a car bomb went off in juarez, mexico across the border from el paso. the classic kind of ied situation that we've only seen in the middle east so far. 21 beds were found, 12 miles south of -- body -- 21 bodies were found 12 miles south of nogales, arizona. this has become a national security issue, not just a border issue. so, i hope that the judge will rule in favor of the state of arizona, who only acted because the federal government had not carried out its responsibilities. >> sean: let me ask you about the long list of democrats -- i've often made the case, democrats are generous with

charlie rangel, congressman massa, john kerry has a lot of explaining to do, all the tax issues the democrats have had yet they want the bush tax cuts to expire. the president last week played the class warfare card. do you think has an impact on the election in 98 days from now? >> to be very frank i think those scandals had an impact on the 2006 elections and the 2008 elections to a lesser degree. i think they have affect and i think the american people are sick and tired of this movement we've seen big government into every aspect of american life, including car companies, health care, including all of those other things that we're seeing a real rebellion. it is a peaceful rebellion. every weekend i go home, i see it is going to be an election day. >> sean: what do you make of

week suggested what your professor friends are saying that it is going to take more stimulus. what was interesting is christina roamer publicly is supportive of obama, but privately she wrote saying the economic damage that will result when obama rolls back to bush -- rolls back the bush tax cuts going to be enormous. >> president's economic team is split on the idea of spending more money on a new stimulus program now. some want it, some don't. and they are split on the idea of increasing taxes on january 1st. some do not want to raise taxes on anybody. most want to impose those tax increases come january 1st. this is administration which on economic policy, is come leadly divided. and heading towards a much, much slower economy and real economic problems in the immediate future. sean, it is not impossible that you will have 10%

appoint from the other day. they had this whole spat last week about gibbs suggesting they might lose the house. she rightly freaked out. but now having to say maybe he was right because they need the fun raising. your other point about independents. a lot of independents are made up of women. they have lost independents at an arm alarming rate. he'll go on the view tomorrow and no president i don't think has ever gone on the view, certainly the president i worked for didn't that is fine maybe he will reach a few people. but he's not willing to change policy. people are extremely skeptical. i'll tell you something else, the white house said today that the plan all along for many weeks has been for obama to go up to do a fundraiser. you know what? if they add an interview for the view, it becomes partly an official trip which means that you and i the taxpayers get to help pay for the tab. >> sean: i'll turn to stuart first, how out of touch -- they just had a vacation in

maine. the president has been playing golf everyday, every weekend. they've got a pending vacation in nantucket. in the interim michelle obama, 30 rooms in a five star resort she headed to spain with her daughter. all these vacations, all these glamorous dinners, all these concerts, all these golf outings, all of this they are projecting an image they are out of touch with an america struggling economically? >> i get the impression the president is not engaged. he's not in touch. he's almost aloof and cold towards the issues of the day. he's not right on top of it, getting to grips with it. i'd like to see him take a vacation in arizona. >> going to florida. >> that's not the same. >> he's going to florida so he can have the excuse to go to martha's vineyard. he said he would go on another vacation if he didn't go to florida. another thing these going to miss tomorrow because he's

>> sean: political insiders are saying charlie rangel is scrambling behind the scenes in a last ditch effort to avoid an embarrassing public hearing. he insists he hasn't reached any agreements yet. >> are you trying to avoid the hearings? >> no, i'm looking forward to a resolution of the very serious allegations that have been made against me. almost two years i've been waiting for an opportunity to respond. >> sean: charlie rangel is busy publicly defending himself new reports veal he could be facing opposition from members of his own party. when asked whether he should resign instead of jumping to his defense steny hoyer took a neutral stance dealing reporters off camera, mr. angle has to do what he believes is appropriate and -- mr. rangel has to do what he believes is appropriate and proper.

pennsylvania congresswoman announced she donating all $14,000 she received in donations from rangel to local charities. why? >> obviously, politically my opponent and others could try to make an issue of my having taken money from charlie rangel. politically, it could become an issue. i sided to take care of it before it did. >> sean: do fellow new york democrats think rangel should resign? our cameras hit the streets today to ask. >> i'm going to wait and see what happens on thursday. what the outcome is. we'll continue to support him until the committee comes up with a report that may not be favorable. >> certainly these are serious allegations. they've been investigated seriously by the appropriate committee in congress. now two wait for all the information to be presented and for congressman rangel to have the opportunity to

present an appropriate and vigorous defense which i expect he will do. >> sean: sounds like he's going to need that vigorous defense. "new york post" reports that investigators have uncovered even more dirt on rangel in addition to the numerous allegations about which we already know could a last minute deal be his only hope? joining me two reporters covering the story from the beginning in d.c. the writer of the washington times water cooler blog kerry picket and from the "wall street journal" james freeman. he's not resigning. >> he sure doesn't seem like he's resigning that's what he told me. the interesting thing here with this whole situation you have one of the safest democratic districts in america and the democrats are extraordinarily worried as to what kind of collateral damage co-affect all over the country. >> sean: these charges are severe. this is nancy pelosi made the comment she is going to drain the swamp.

steny hoyer distanced himself. i never said drain the swamp that was pelosi's comments. more infighting after they were battling the comments of robert gibbs. >> democrats want more than anything for him to cut any deal this is not a legal proceeding, it is a political proceeding. but it is going to be like a trial in public. lawyers calling witnesses, cross-examining witnesses. they've subpoenaed a ton of documents, it is going to be ugly. >> sean: you would have thought from a political point of view that nancy pelosi would have gotten rid of this a long time ago. why did they let it linger to the point where rangel holds a lot of cards here? >> absolutely. here's the problem, the democrats are caught between a rock and hard place. one of those situations where if they actually let the trial go on, so to speak, then it is throughout the entire campaign season, people are gng to have this hear this constant

drum beast this rangel situation. if he just plead -- drum beat of this rangel situation. if he just pleads then it goes away. we have to wait and see how this politically plays out. >> sean: how does it work out? charlie rangel chairman of the house ways and means committee. they write tax law, tax cheat geithner, sebelius, at some point somebody has to pay their taxes. i know i do. >> you would think. there seems to be a pattern emerging. the idea that he's still going to fight this he has already admitted that he didn't pay the taxes. it is not a question of did he or didn't he? he already acknowledged that he didn't report the income from his property in the dominican republic. remember, even if he cuts day with committee lawyers he still needs one of the republicans on the committee to seen off -- to sign off on

it. >> sean: what i'm hearing in fact the democrats were close to a deal with one hitch. they didn't bring republicans in on the negotiation. >> i asked charlie rangel about that tonight. he's saying that he himself did not meet with the chairwoman of the ethics committee. however, he is saying there are no deals that were made last night. none of that necessarily happened. his lawyers that's a whole other story. they may be doing more dealings that may be the wiggle room he's going towards. >> sean: last time this happen was with james traficant. is there a possibility he's got himself legal problems when is all said and done in a court of law? >> it may not just be legal problems, but it could be financial problems. a problem like this is extraordinarily expensive. >> sean: if he stays co-raise money for his legal defense. >> he has to worry about legal

as of january 1st, 2011, 157 days from now what happens and who does it impact? >> it impacts everybody. even if the democrats have their way and the administration has its way and they've kind of choose winners and losers in this thing and only tax a small percentage of people. major income tax hike. talking about the top rate going to 39.6%, by 2013 with additional taxes and obama care and phasing out of deductions the top income it that rate. all the rates go up. capital gains rates are going up by a third. dividend rates for people who have a little stock we tack those folks investing in the stock market. we want investment but tax folks making a little money on

investment, capital gains. plus the child tax credit. and the marriage penalty on down the line. another deduction phased out as we go. >> sean: you add the 44% if you live in new york that's 54%. if you live in new york city, you a city tax. then a huge sales tax. then property taxes. you are well over 60% of your nick. liberals still tell you, you are not paying your fair share and the rich need to pay more. explain why that is a fallacy? why that would impact lower and middle income americans? >> every politician that ever run for office ought to be asked a simple question: how long -- she we work for the government, two days, three days? a lot of people would be surprised how long we work for the government. this administration is trying

its best to kick the economy while it's down. it is trying to sell the american people on the notion that if they will just limit the tax increases to the upper income group that it won't affect them. but you're talking primarily small businesses. the engine of growth in this the folks who hire most of the people in this country. 20 million people, these small business people hire. people who worked hard all their lives in many instances just got to that upper bracket. we are a fluid society. we're not born in one tax bracket and stay there. we've been in every tax bracket as we go along. producers and the engines of growth and the people that hire folks. we've got 1.8 trillion dollars sitting on the sidelines, they say, in this economy. in this country now by business because they are

afraid. afraid of what is going to kick in next year in terms of taxes and regulation. as you like to say, i've never been hired by a poor person. >> sean: never have been. those were my years in the restaurant business and construction or any of the years that i've been in media. i put the question differently. the way i ask is, at what point do we cap the percentage of your income what you make that has to go to the government? let me ask you this, it seems democrats, some of them, conrad, evan bayh and others trying to posture they are actually against eliminating the cuts or letting them expire. but on the other hand that's -- are you encouraged or as cynical as i am that they are just playing a political game they want them to expire and they can claim they opposed it? >> i don't know. i can read their mind. i was impressed when conrad

came out. he's the chairman of senate budget committee, democrat. and he said, you know, it is not a good idea to increase taxes in a down economy. well, as the kids would say, duh! that's almost a you -- unanimous consensus. conrad is not the only one who feels that way the father of keynesian economics felt the same way. and i think democrats are hearing the music a little. people are not as susceptible to having their envy played upon as this administration thinks. they think if they can do something even if it hurts the economy, that is going to take something away from a group they are not a part of, the two or three percent the way they like to put it, that will go over well politically and they can win that. rich versus poor. we just through a segment of
